2. What Information We Collect

• Device data: If you connect our smart garden, we store its unique device ID
• Images: Photos you upload for plant identification, health check, or community sharing
• Usage data: Anonymous analytics on how you interact with the app
• AI inputs: Text and image queries submitted to the AI assistant
• Community content: Plant posts and comments you share with others
• Crash logs and performance diagnostics to monitor and improve app stability

3. How We Use Your Data

Your data is used to:

• Create and manage your user account
• Provide personalized plant care advice
• Operate our AI assistant (powered by OpenAI)
• Power app features like community posts, reminders, and diagnostics
• Improve functionality through analytics and performance tracking
• Sync and manage UrbiGrow smart gardening devices
• Send app notifications (which you can disable at any time)

Legal Bases for Processing (GDPR Art 6): 

• Contract – We need certain data to provide what you requested: create and maintain your account, sync the UrbiGrow device, deliver plant-care recommendations, send essential service messages, and enable core in-app features such as reminders.
• Consent – You choose to upload plant photos for diagnosis, post content in the community forum, subscribe to newsletters, or allow push notifications. You can withdraw consent at any time in the app or by emailing us.
• Legitimate interest – We process minimal data for security (fraud prevention, abuse detection, server-log monitoring) and for aggregated analytics that help us improve performance. These interests are balanced against your privacy rights.
• Legal obligation – We keep certain records (e-mail logs, transaction data, tax documentation) and may disclose information to authorities when required by law.

4. Third-Party Services We Use

We use trusted processors to operate our services:

• OpenAI – AI-based plant support chat
• Google – Login and analytics services
• Mailgun / Mailchimp – Email notifications and newsletters
• Sentry – Crash reporting and performance monitoring to improve app stability

All processors are contractually bound to protect your data and act in compliance with GDPR and other applicable laws.

5. Sharing Your Information

We do not sell your personal data. We may share data:

• With our authorised processors (listed above) under strict confidentiality
• To comply with legal obligations or government requests
• To detect and prevent fraud, abuse, or security threats
• If you share content (e.g. photos, comments) in the public parts of the app

7. Data Retention

We retain your data for as long as your account is active or as necessary to provide services and comply with legal obligations. You can delete your account and data at any time via the app or by contacting us. 

Data Retention:
We retain personal data while your account is active and erase it within 30 days after deletion. Raw analytics events remain for 24 months, after which we keep only aggregated, anonymous statistics. Email logs are stored for 18 months to satisfy tax and anti-spam obligations. You can remove all personal data at any time via the in-app “Delete Account” option or by emailing info@urbigrow.com.

8. Children’s Privacy

Our app is not intended for children under the age of 13. We do not knowingly collect personal data from individuals under the age of 13. If you believe a child has provided us with their data, please contact info@urbigrow.com, and we will delete it promptly.

9. International Data Transfers

Your data may be processed or stored outside your country of residence, including in the United States. We utilize appropriate safeguards, such as Standard Contractual Clauses (SCCs), to ensure lawful data transfers in accordance with the GDPR.

10. Additional Privacy Rights for U.S. Residents

If you are a resident of certain U.S. states (e.g., California, Virginia, Colorado, Connecticut, Utah, Oregon), you may have specific rights under applicable state laws:

• Right to know what categories of data we collect and how we use it

• Right to correct inaccurate data
• Right to delete personal data, with limited exceptions
• Right to opt-out of sale or sharing (we do not sell or share data)
• Right to limit use of sensitive data (we use only to operate the app)

We do not sell your personal data or share it for advertising.

11. Changes to This Policy

We reserve the right to update this Privacy Policy as needed. When we make the changes, we will post them on our website and in the app. Continued use of the app after changes constitutes acceptance.
